1. Security Safeguards: We adopt multiple technical, administrative and physical protection measures to protect user data from unauthorized disclosure or alteration. These Terms of Use apply to all websites, applications, products and services provided to you by 【Dyness Digital Energy Technology Co., Ltd.】 (hereinafter referred to as “we,”“us”or“our”), including but not limited to corporate websites, user monitoring platforms, developer platforms, community websites, supporting applications and API services.                

I. User Account Rules

1. When completing the registration process, you must provide true, accurate and complete information concerning the relevant individual or business entity. Such information will serve as your identity credentials for using services including remote monitoring of energy storage systems, intelligent energy scheduling and energy consumption data analysis.                

2. You must properly safeguard your account login name, password and two-factor authentication information. All service operations, equipment commands and order submissions initiated through your account will be deemed to have been actively performed by you, and you will bear the corresponding rights, obligations and responsibilities.                

3. If you discover any abnormal login or operation that was not performed by you, please contact our customer service team immediately. We will assist you in freezing risky account operations and investigating the source of the abnormal activity.                

4. Your account may only be used by you personally or by your business. Without our written permission, you may not lend, lease or sell your account access rights to any third party. Otherwise, we have the right to suspend all of your service access rights.                

II. Equipment Operation Assurance Rules

1. You are independently responsible for the installation, operation and maintenance of the equipment and must ensure that the equipment is maintained in a normal operating environment.                

2. We reserve the right to conduct remote diagnostics and system upgrades in order to ensure the operational stability of solar and energy storage equipment. Temporary service interruptions may occur during an upgrade. We will notify you in advance through in-platform notifications or the contact information you have provided.                

3. If the equipment remains offline and unresponsive for an extended period, the system will automatically trigger a safety shutdown mechanism to protect the safe operation of the power grid.                

III. Intellectual Property Provisions

1. All intellectual property rights in the system code, functional interfaces, energy algorithm models, operating manuals and promotional content available on our platform belong to us.                

2. We grant you only a limited right of use for personal and internal business purposes. Without written authorization, you may not reproduce, distribute or conduct secondary development of such materials for any commercial purpose.                

3. The intellectual property rights in your proprietary content uploaded to the platform, including your own power station project drawings and customized energy consumption data, belong to you. We may use such content to provide you with customized energy optimization solutions only after obtaining your explicit authorization.                

IV. Allocation of Rights and Responsibilities

1. We expressly inform you of the risks associated with using the open internet. To the extent permitted by law, we will not be liable for compensation for temporary service interruptions caused by force majeure events, including but not limited to power grid scheduling interruptions, natural disasters and network failures of telecommunications operators. However, we will promptly coordinate resources to assist you in restoring the normal operation of your equipment.                

2. All intelligent energy scheduling recommendations are reference solutions generated on the basis of real-time operating data. You may independently decide whether to implement such recommendations according to your actual electricity consumption requirements. We will not directly bear corresponding liability for fluctuations in electricity costs or changes in power generation caused by the operating strategies independently selected by you.                

V. Updates to the Terms and Dispute Resolution

1. We have the right to amend these Terms according to service updates and changes in applicable laws and regulations. The amended version will be published on our official website at least 15 business days in advance.                

2. For material changes, users will be required to confirm the changes through a pop-up notification before continuing to use the services. Your continued use of the services will be deemed acceptance of the updated agreement.                

3. If you violate any provision of these Terms and fail to make timely corrections after receiving a notice, we have the right to terminate the provision of all services to you.                

4. Dispute resolution will be subject to the applicable local jurisdictional rules and will fully comply with the compliance requirements applicable to cross-border business operations.
